Secure Peace of Mind for Your Family When an Unexpected Death Occurs

Rhode Island Guardianship Attorney

Protecting the People you Love

No parent likes to imagine passing away before their children are old enough to look after themselves, but the very unpleasantness of the prospect makes guardianship planning all the more important. By working with an experienced Rhode Island estate planning attorney now, you can make your wishes known in a legally binding way.

What Is a Guardianship?

Guardianship is a court appointment which gives a person responsibility and authority for making decisions on behalf of an adult who is unable to manage his/her own affairs and make his/her own decisions. The person for whom a guardian is appointed is called a “ward.”

Guardianship planning is as complicated and unique as the individual families and circumstances it touches. For every case, many specific questions have to be answered, and only by drafting a plan in advance can you adequately cover them all.

Specifically, your guardianship plan has to anticipate:

  • Physical custody of your minor children: We help you devise a succession plan to ensure the children you love are left in the care of the people you trust.
  • Asset transfer: We can establish a trust for your children, complete with special provisions for education funding and distribution of life insurance proceeds. Disputes over these can sometimes bring surviving family members to court. We help you avoid that unpleasantness with a clear, simple plan for your wealth that will be upheld by the court.
  • Special directives: Not every wish you have for your children is financial. Many of us hope our children grow up in our church or attend school. By drafting plans in advance, we can help you convey those desires to your children's guardians in a way that can't be misunderstood.
  • Caregiver instructions: Every parent knows things about their kids that only a mom or a dad could know. From detailed instructions for the care of a special-needs child, to the fact that your son only eats lima beans if there's ice cream for dessert, we can help you pass special instructions along to caregivers to help ensure continuity and stability in your children's lives.

Guardianship is a serious responsibility and one that should be approached with the same attention which you apply to your own life. Besides being a “legal representative” for your ward, you will also be an advocate and watchdog. While guardianship provides important protection and assistance, it is also very restrictive. It can remove all of a person’s legal rights to manage his/her own life and must be imposed only as a last resort.

What Are the Responsibilities of a Guardian?

If you are considering becoming a guardian for someone you must first consider if limited guardianship would be sufficient. Limited guardianship may include authority to make only medical decisions, only residential decisions, or only financial decisions. Or it may include a combination of one or two areas. In all other matters, the guardian has no authority. An unlimited guardianship can be reduced to a limited guardianship, or the reverse can be done, through a petition to the court which made the initial guardianship appointment.
